DHS Proposes $103,265 Fee for H-1B Cap-Subject Petitions

The U.S. Department of Homeland Security has proposed a new $103,265 fee for employers sponsoring H-1B workers selected through the annual cap lottery, expected to generate approximately $8.8 billion annually. The fee would apply to cap-subject petitions filed on or after a final rule is issued, with a public comment period open through September 24, 2026, and would not affect cap-exempt H-1B extensions or petitions by certain nonprofit and governmental organizations.
